Recreational fires (City Code 12-415) will be allowed without a permit but are subject to limitations which are strictly enforced.
Chimneas are made of clay and come in various shapes, sizes and colors. Chimneas are considered recreational in nature and are subject to City Code 12-415 pertaining to recreational fires.
The following rules will apply:
Burning will be allowed from 8 a.m. - Midnight any day of the week, with a maximum duration of 6 hours recreational fire any day of the week.
Recreational fires shall not exceed 3 feet in diameter and a flame height of approximately 3 feet.
Only clean dry wood may be burned, with a minimum of 1 inch diameter. No brush, yard, building, household waste or treated wood may be burned (City Code 12-415).
A responsible adult must be present at all times.
The fire must be located on your own property. If the fire is in an easement area, you must have approval from all involved parties.
A means of controlling or extinguishing the fire must be available at all times (Buckets, shovels, and garden hoses, for example).
Fires are not allowed if winds are in excess of 15 miles per hour. Current weather conditions may be checked on the National Weather Service website. Enter your zip code into the search box for current conditions.
Recreational fires shall not be conducted within 25 feet of a structure.
Any police or fire officer may withdraw permission for the fires due to climatic conditions, extreme dryness, nuisance problems, or violations of the guidelines.
A person violating any recreational fire provisions of City Code Section 12-415 is subject to an administrative citation with a penalty of $75. A 2nd time or subsequent time within 18 months of a previous violation is subject to an administration citation with a penalty of 2 times the previously imposed penalty.
Remember: You are responsible for any damage caused by your fire, so stay safe and follow the rules in place for you.
